BPT Portal – Terms of Service

1. Acceptance of Terms

By creating an account, purchasing credits, uploading files, placing orders, or using any service provided through BPT Portal ("BPT", "we", "our"), you agree to these Terms of Service.

2. Services

BPT Portal provides ECU, TCU, software modification, file processing, diagnostics, engineering support, vehicle lookup services, and related digital services.

All services are supplied electronically and are intended for professional or enthusiast use.

3. Credits

Credits purchased through BPT Portal are digital products.

Credits:

  • are non-transferable;
  • cannot be exchanged for cash;
  • may only be used within the BPT Portal platform; and
  • expire 12 months after purchase unless otherwise stated.

4. Payments

Payments are processed through third-party payment providers, including Stripe.

BPT does not store or process payment card information directly.

The user is responsible for ensuring that payment information is accurate and valid.

5. Refund Policy

Due to the digital nature of our services, all credit purchases are generally non-refundable.

If BPT determines that a supplied file contains an error that cannot be resolved through reasonable support and revision attempts, BPT may issue a credit refund to the user's account at its sole discretion.

Any refund issued will normally be in the form of account credits and not cash.

6. Chargebacks and Payment Disputes

If a user initiates a chargeback, payment dispute, or payment reversal for services already delivered, BPT reserves the right to:

  • suspend the account;
  • freeze account credits;
  • withhold active orders;
  • recover outstanding balances; and
  • permanently terminate access to the platform.

7. Customer Responsibilities

Users are responsible for:

  • uploading the correct original file;
  • selecting the correct options and requested services;
  • ensuring vehicle compatibility;
  • verifying all information before submitting an order;
  • maintaining suitable hardware and software; and
  • following all instructions provided by BPT.

If incorrect files or information are supplied, additional charges may apply.

8. Warranty Period and Revisions

Any support request relating to a supplied file must be reported within 21 days of delivery.

Revisions are intended solely to address issues directly related to the original order.

Requests for additional features, new solutions, or major changes may be treated as a new order and charged accordingly.

9. Vehicle Condition

All software is supplied on the assumption that the vehicle is mechanically sound.

BPT accepts no responsibility for faults, damage, drivability issues, or failures caused by:

  • existing mechanical problems;
  • hardware defects;
  • poor maintenance;
  • incorrect installation;
  • unsupported modifications;
  • improper flashing procedures; or
  • user error.

10. Flashing and Tool Risks

The user is solely responsible for the tools, equipment, power supply, batteries, chargers, interfaces, and flashing procedures used.

BPT shall not be liable for:

  • failed writes;
  • communication errors;
  • ECU or TCU corruption;
  • interrupted flashing;
  • tool malfunctions;
  • clone tool failures; or
  • damage resulting from user equipment.

11. Data Logging and Support Evidence

Where support is requested, users may be required to provide:

  • diagnostic reports;
  • fault codes;
  • original files;
  • modified files;
  • data logs;
  • dyno results; and
  • other relevant evidence.

Failure to provide adequate information may limit BPT's ability to investigate or provide support.

12. No Performance Guarantee

Performance results vary between vehicles.

BPT does not guarantee any specific:

  • horsepower increase;
  • torque increase;
  • fuel economy improvement;
  • top speed increase;
  • exhaust sound characteristics; or
  • performance outcome.

Any published figures are estimates only unless otherwise stated.

13. Emissions and Road Legality

Certain modifications may affect emissions systems, vehicle compliance, or road legality depending on local laws and regulations.

The user is solely responsible for ensuring that any modification is legal in the country, region, or jurisdiction where the vehicle is operated.

BPT makes no representation that any supplied modification is legal for road use in every jurisdiction.

14. Motorsport and Off-Road Use

Certain products, solutions, or software modifications may be intended for motorsport, competition, testing, export, or off-road use only where permitted by law.

The user is solely responsible for determining whether such use is lawful.

15. Limitation of Liability

To the maximum extent permitted by law, BPT shall not be liable for:

  • vehicle damage;
  • engine damage;
  • gearbox damage;
  • loss of profits;
  • loss of business;
  • loss of data;
  • downtime;
  • recovery costs; or
  • indirect or consequential losses.

The use of any supplied file or software is entirely at the user's own risk.

16. Intellectual Property

All files, calibrations, software modifications, solutions, documentation, and materials supplied by BPT remain the intellectual property of BPT unless otherwise agreed in writing.

Users may not redistribute, resell, publish, share, reverse engineer, or otherwise distribute supplied files without prior written permission.

17. File Storage

BPT may retain uploaded files, processed files, logs, and order-related data for operational and support purposes.

BPT does not guarantee permanent storage of files and users should maintain their own backups.

18. Third-Party Services

BPT may rely on third-party providers including payment processors, hosting providers, cloud services, APIs, and vehicle data providers.

Temporary outages, interruptions, or failures of such services do not create liability for BPT.

19. Account Suspension

BPT reserves the right to suspend or terminate any account for:

  • abuse of services;
  • fraudulent activity;
  • chargebacks;
  • unauthorized redistribution of files;
  • multiple accounts;
  • misuse of the platform; or
  • violation of these Terms.

Unused credits may be forfeited where permitted by law.

20. Privacy

User data is handled in accordance with our Privacy Policy.

By using BPT Portal, you consent to the collection and processing of data necessary for providing our services.

21. Changes to These Terms

BPT may update these Terms of Service at any time.

Continued use of the platform after updates are published constitutes acceptance of the revised terms.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Norway.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Norwegian courts.
